The authors of this article are previous or current members of the Clinical Ethics Consultation Affairs (CECA) Committee, a standing committee of the American Society for Bioethics and Humanities (ASBH). The committee is composed of seasoned healthcare ethics consultants (HCECs), and it is charged with developing and disseminating education materials for HCECs and ethics committees. The purpose of this article is to describe the educational research and development processes behind our teaching materials, which culminated in a case studies book called (...) A Case-Based Study Guide for Addressing Patient-Centered Ethical Issues in Health Care (hereafter, the Study Guide). In this article, we also enumerate how the Study Guide could be used in teaching and learning, and we identify areas that are ripe for future work. (shrink)

Recent financial fraud legislation such as the Dodd–Frank Act and the Sarbanes–Oxley Act (U.S. House of Representatives, Dodd-Frank Wall Street Reform and Consumer Protection Act of 2010, [H.R. 4173], 2010 ; U.S. House of Representatives, The Sarbanes–Oxley Act of 2002, Public Law 107-204 [H.R. 3763], 2002 ) relies heavily on whistleblowers for enforcement, and offers protection and incentives for whistleblowers. However, little is known about many aspects of the whistleblowing decision, especially the effects of contextual and wrongdoing attributes on organizational (...) members’ willingness to report fraud. We extend the ethics literature by experimentally investigating how the nature of the wrongdoing and the awareness of those surrounding the whistleblower can influence whistleblowing. As predicted, we find that employees are less likely to report: (1) financial statement fraud than theft; (2) immaterial than material financial statement fraud; (3) when the wrongdoer is aware that the potential whistleblower has knowledge of the fraud; and (4) when others in addition to the wrongdoer are not aware of the fraud. Our findings extend whistleblowing research in several ways. For instance, prior research provides little evidence concerning the effects of fraud type, wrongdoer awareness, and others’ awareness on whistleblowing intentions. We also provide evidence that whistleblowing settings represent an exception to the well-accepted theory of diffusion of responsibility. Pressure is mounting to hold researchers and research institutions accountable for the protection of human subjects. When subjects or their family members believe they have been injured, they are increasingly willing to file lawsuits. Recent cases indicate that institutional review boards and their members may be pulled more and more into the legal fray.On September 17, 1999, 18-year-old Jesse Gelsinger died while participating in research conducted by the University of Pennsylvania's Institute for Gene Therapy. Gelsinger was involved in a Phase (...) I clinical trial testing a new approach to treatment of ornithine transcarbamylase deficiency, a rare metabolic disorder. Although infants affected by the severe form of OTC die shortly after birth, Gelsinger suffered from a relatively mild form. It appears undisputed that the cause of Gelsinger's death was not the disorder itself, but multiple organ system failure triggered by the virus used to carry new genetic material into his system. Cloth, $160.The inspiration for this book derives from a 2008 conference at the University of Warwick that was held in recognition of the twentieth anniversary of the (...) publication of the first volume of Black Athena. African Athena is the title Martin Bernal once said that he “should have used” for his multivolume project, but his publisher “insisted on” using Black because it would “sell” (“Black Athena and the APA,” Arethusa 22 [1989]: 31–32). In his autobiographical afterword to this volume, he admits that the title Black Athena “may well have had the effect” of exposing critics of his books to charges of racism, as indeed it did. So the use of the alternate title for the present volume represents a welcome shift in emphasis from issues of race to issues of culture and nationality, and the reception of Greek and Roman ideas by later writers. Some of the essays in the volume are based on papers given at the Warwick conference; other contributors were specially invited. The chapters in the first part of the book are primarily historiographical in nature, while most of the essays in the second part consider the literary and historical productions of particular authors. The editors provide an introductory overview of each contribution, with a helpful survey of some of the other recent work in this emerging field, and offer some brief general remarks. But it is not [End Page 347] clear why certain important topics (e.g., the works of Jean Terrasson or Cheikh Anta Diop) were not treated in more depth. Of course, no collection can have the coherence of a work by an individual author, and the essays in this volume seem largely independent of one another. If there was any discussion among the authors who presented their papers in the conference, or commentary on them by Bernal himself, few traces of such interchange appears in the published book. Readers are left to make such connections as best they can.There are, however, some commonalities among the papers. Most concentrate on reception, and do not consider the historical issues that have made Black Athena the subject of such heated debate. That does not mean that the editors or most of the authors believe that the debate has been in any way resolved; rather, it appears that they have sought to avoid discussion of the historical issues involved in Bernal’s reconstruction of the ancient past, seeking instead to concentrate on the “ongoing relevance of the issues Bernal raises.” Although works by Bernal’s most outspoken critics are mentioned, there is only occasional reference to what they actually said and no specific discussions of the particular reasons why most scholars of the ancient world believe that Bernal has vastly overstated the degree of Egyptian influence on Greece and misinterpreted such evidence as there is, especially in the case of his proposed new etymologies. Some of the contributors seem sincerely puzzled by the relative lack of attention accorded to Black Athena. Volume III: The Linguistic Evidence (New Brunswick, N.J. 2006). For example, Patrice Rankine in his chapter “Black Apollo?” is impressed by the “patience and meticulous attention to sources” displayed in Bernal’s claim (based on the epithet λυκηγενής) “that European scholars dislodged Apollo from his Egyptian connection” to Sun worship. Rankine believes that it is mainly because of “the context of North American intellectual life” that such proposals failed to persuade classicists and Indo-Europeanists. He does not appear to have supposed that there might be other, far more compelling reasons why linguists have thought that Apollo’s origins might more credibly be traced to Lycia or Anatolia.Rankine and other contributors to the volume call attention to the nationalism and other types of Zeitgeist that have caused European scholars to ignore or downplay the contributions of Egypt and other African cultures. Prior studies have shown a general preference among citizens for juries over judges. Researchers, however, have not considered whether race and ethnicity modify this preference. We hypothesized that minorities (African-Americans, Hispanics), who generally express less trust in the legal system, may also express less trust in juries than non-Hispanic whites. We asked a representative sample of 1,465 residents of Texas to state whether they would prefer a jury or a judge to be the decision maker in four hypothetical circumstances. Consistent (...) with expectations, non-Hispanic whites favored juries over judges, particularly if they imagined themselves as a defendant in a criminal trial. By comparison, although African-Americans and some Hispanics generally favored juries, they showed a much weaker set of jury preferences. African Americans had markedly lower support for the civil jury, but support was higher among minorities with prior jury service. Among Hispanics, respondents who took the survey in Spanish typically preferred a judge to make legal decisions. We consider the implications of our findings for trust in the jury system and trust in community members as decision makers. (shrink)

In the surviving plays of Aeschylus and Sophocles the gods appear to men only rarely. In the Eumenides Apollo and Athena intervene to bring acquittal to Orestes. In Sophocles' Philoctetes Heracles appears ex machina to ensure that the hero returns to Troy, and we learn from a messenger how the gods have summoned the aged Oedipus to a hero's tomb. In Sophocles' Ajax Athena drives Ajax mad and taunts him cruelly. Prometheus Bound might seem to be an exception, since all (...) but one of its characters are gods. But nonetheless the intervention of the gods in the life of the one human character, Io, brings pain and trouble as well as promise of benefit. Io has been driven mad because she has refused to obey the dreams that tell her to go to the meadow where Zeus wants to have intercourse with her. The god does not make his request in person, and it is only in the course of her wanderings that Io learns how Zeus will bring a gentle end to her sufferings. Her informant is another god, Zeus' adversary Prometheus, who answers her questions, at times grudgingly , and in ways that are not immediately clear to her. (shrink)

The old proverb can still more accurately be applied to their biographers.‘ Even the more plausible and psycho logically tempting details in the lives of literary figures derive from these authors’ fictional works, poems, and dramas, and not from the kind of source material biographers use today, letters, documents, eyewitness testimony. Critics and readers eager to establish some historical correlation between any ancient poet's life and his work should expect to be disappointed. But even if the ancient lives are useless (...) to the historian or critic trying to explain what in Euripides’ experience compelled him to write about Medea, these stories are of interest to mythologists. If we stop being angry at the Lives for failing to be historical, and look at them rather as myths or fairy tales, some informative patterns begin to emerge. (shrink)

Clinical experience suggests that adult survivors of childhood trauma arrive at their memories in a number of ways, with varying degrees of associated distress and uncertainty and, in some cases, after memory lapses of varying duration and extent. Among those patients who enter psychotherapy as a result of early abuse, three general patterns of traumatic recall are identified: relatively continuous and complete recall of childhood abuse experiences coupled with changing interpretations of these experiences, partial amnesia for abuse events, accompanied by (...) a mixture of delayed recall and delayed understanding, and delayed recall following a period of profound and pervasive amnesia. These patterns are represented by three composite clinical vignettes. Variations among them suggest that the phenomena underlying traumatic recall are continuous not dichotomous. Future research into the nature of traumatic memory should be informed by clinical observation. (shrink)

Pindar, perhaps more than any other ancient poet, seems to demand from his interpreters declarations of their critical premises. In recent years scholars customarily have made initial acknowledgment to the work of E. R. Bundy, as psychoanalysts must to Freud, before they begin to offer their own modifications to and expansions of his fundamental work. Much contemporary scholarship has concentrated on the identification and classification in the odes of the elements whose function Bundy labelled and explained. But useful as this (...) type of analysis has been for exorcising the demon of biographical interpretation, it has, like all orthodoxies, prevented perception of other equally important truths. It constitutes no radical heterodoxy to try to account for the fact that each individual ode, for all its dependence on common conventions of structure and of content, makes a different impression. Nor is it unreasonable to try to explain what makes Pindar's style and approach distinctive.In my own work I have argued, though perhaps not always convincingly, that language as well as structure contributes to an ode's coherence. Scholars trained in America are more willing to assume that repetition of phrase or theme within a poem has significance, and that metaphors can simultaneously bear more than one connotation. The issues at stake have most recently been delineated by Michael Silk, in his discussion of the effect of metaphor in archaic poetry: ‘By “patent”, I mean effects whose existence is not in doubt, though their character may be disputed; by “latent”, those whose effective significance is so tenuous or marginal that one resents the impression of solidity that even mentioning them produces. Such insensitivity is more common than it should be among American classicists, many of whom have also been influenced by the “New Criticism”…’ As illustration of the erroneous American approach Silk cites Cedric Whitman's description of the thematic relation of fires in theIliad.Silk himself avoids the trap Whitman falls into by considering only ‘patent’ metaphors, and these consistentlyout of context, so that there is no necessity to comment on the existence or non-existence of thematic connections among them. But it is possible—at least logically—to frame the question differently, and to ask whether a metaphor cannot have patent and latent associations at the same time. (shrink)

This article focuses on two possible missions for a national bioethics commission. The first is handling differences of worldview, political orientation, and discipline. Recent work in political philosophy emphasizes regard for the dignity of difference manifested in "conversation" that seeks understanding rather than agreement. The President's Council on Bioethics gets a mixed review in this area. The second is experimenting with prophetic bioethics. "Prophetic bioethics" is a term coined by Daniel Callahan to describe an alternative to compromise-seeking "regulatory bioethics." It (...) involves a critique of modern medicine. In the contemporary context, the areas of biotechnology and access to health care cry out for prophetic attention. The Council has addressed biotechnology; unfortunately, that experience suggests that the kind of prophecy that it practices poses risks to conversation. With regard to access issues, the article proposes an effort that unites themes of human dignity, solidarity, and limits in support of reform, while highlighting, rather than papering over, differences. From certain sorts of premise, individuals reliably infer invalid conclusions. Two Experiments investigated a possible cause for these illusory inference: Reasoners fail to think about what is false. In Experiment 1, 24 undergraduates drew illusory and control inferences from premises based on exclusive disjunctions (“or else”). In one block, participants were instructed to falsify the premises of each illusory and control inference before making the inference. In the other block, participants did not receive these instructions. There were more correct answers (...) for illusory disjunctions whose premises had been falsified than there were for illusory disjunctions that had not been falsified. A second Experiment introduced illusory inferences in a real world context that accentuated falsification of premises. Accuracy also improved. Knowledge of how to falsify premises and to consider their implications for true premises transferred to a new problem introduced at the end of the Experiment without the falsification instruction. The participants' ratings of the difficulty of the inferences showed that they did not err simply because illusory inferences are perceived to be more difficult than control problems. The model theory predicts these results because it postulates that the limitations of working memory preclude the representation of false information. (shrink)

Recent work in experimental philosophy has shown that people are more likely to attribute intentionality, knowledge, and other psychological properties to someone who causes a bad side effect than to someone who causes a good one. We argue that all of these asymmetries can be explained in terms of a single underlying asymmetry involving belief attribution because the belief that one’s action would result in a certain side effect is a necessary component of each of the psychological attitudes in question. We argue further that this belief-attribution asymmetry is rational because it mirrors a belief-formation asymmetry, and that thebelief-formation asymmetry is also rational because it is more useful to form some beliefs than others.
